A legal basement apartment in Milton starts with two checks: that your house is a type the Town’s additional unit rules cover, and that the lot has municipal water and sewer. Then we design the separate entrance, fire separation, egress windows and heating for two households, file the set with the Town of Milton Building Division through the Amanda Permit Portal and build the unit.

(416) 990-9179A building permit for the unit, applied for with drawings at Milton’s own building department rather than Halton Region. The stairwell for a new entrance changes the grade beside the house, and Milton’s site alteration by-law reaches house lots too, past its exemptions for minor landscaping, so we check the stairwell against it. We prepare and file the set and deal with the examiner’s comments.
Only where the lot is inside Conservation Halton regulation, near a watercourse, a valley or a floodplain. Digging a stairwell down to the basement changes the grade there, and the Conservation Halton permit may be needed before Milton issues the building permit. We check the regulation mapping before the entrance is drawn.
In Milton’s urban area, a property with municipal water and sewer connections that has a detached house, semi-detached house, semi-link house or townhouse (not stacked or back-to-back townhouses) can have up to three additional residential units, with no more than one of them in a detached building on the same lot. In January 2026 the Town updated its Official Plan and Zoning By-law to allow additional residential units in rural areas, with limits that vary by zone. The house type matters as much as the basement here, so we confirm yours is one the rule covers before any drawing starts.

Three things to start: property address; basement ceiling height, measured floor to joist; and photos of the basement, the mechanical room and the outside wall where an entrance could go. Send those and we tell you what the Town of Milton Building Division will ask for before we quote.
The one for the area the house is in: Zoning By-law No. 016-2014 in the urban area, or No. 144-2003 on a rural property. In January 2026 the Town changed its Official Plan and zoning so rural properties can have additional units too, within limits that depend on the zone, so for a rural house we read that zone’s limits before anything is drawn for the Town of Milton Building Division.
On a serviced urban lot, the count allows it: a qualifying house in Milton can have up to three additional units, and one of those may stand in a detached building. A basement unit plus a garden suite fits that, so we draw the basement with the side yard kept clear for the suite’s water and sewer route. The Town of Milton Building Division reviews the suite as a new building when you go ahead with it.
Yes. We start the application in the Amanda Permit Portal, the Town of Milton’s online permit service, and whoever is signed in as the applicant can see the file and its status there. If the examiner at the Town of Milton Building Division comes back on the fire separation, the exit or the headroom, we answer each comment and upload revised sheets until the permit is issued.
That depends on two sets of rules. Ontario’s O. Reg. 299/19 asks for one space per additional unit, and a tandem space behind the main household’s car is allowed, unless the zoning by-law needs no space for the main unit or says none is to be provided for the extra one. We check the parking rules in Zoning By-law No. 016-2014 for your lot and show the space on the site plan the Town of Milton Building Division reviews.
It can, since digging the entrance stairwell cuts roots close to the house. The Town of Milton advises getting a certified arborist’s opinion before you remove a tree that stands wholly on your property, and on a lot over 0.5 hectares or wholly inside the Regional Greenlands System it points owners to Halton Region’s tree removal regulations. We plot the trees from the survey and pick the side for the entrance that leaves them standing, before the set reaches the Town of Milton Building Division.

The code calls it a secondary suite, and Ontario’s planning rules call it an additional residential unit. Fine Engineering designs and permits these units across the GTA and coordinates the build.
At least 1.95 m, about 6 ft 5 in, under Ontario’s 2024 Building Code, with 1.85 m of clear height allowed under beams and ducts. The measurement runs from the finished floor to the finished ceiling, so new flooring and drywall count against it. Fine Engineering measures the height at the first site visit, before any layout is drawn.
It needs a safe way out, which is usually its own exterior door. In a house that has stood for five years or more, the 2024 Building Code’s renovation rules also accept an exit route through the other unit, as long as the suite gets an extra escape window that opens from inside without tools and the smoke alarms are linked. Fine Engineering works out which route suits the layout.
Yes. Once a house has a secondary suite, its smoke alarms must be interconnected, by wire or wirelessly, so one sets off the rest, and shared spaces need them too. A suite with a fuel-burning appliance, or one sharing a wall, floor or ceiling with such an appliance or a garage, also needs carbon monoxide alarms by its bedrooms. Fine Engineering marks every alarm on the permit set.
For many homeowners, yes. A legal second unit can earn rent and add property value, and because it was built under a permit, it avoids the trouble an unpermitted suite causes when the house is sold. The return depends on how much the basement needs, whether that is more headroom, a new exit or fire separation. Fine Engineering prices that work before any drawing starts.
Usually because the heat reaching the room does not match the heat it loses. A room over a garage, or one with more glass and outside wall, loses heat faster, and a long or undersized duct delivers less air than the room needs. A room-by-room heat-loss calculation and a duct design show where the gap is. Fine Engineering does both for existing houses as well as new ones.

In Milton the reviewer is the Town of Milton Building Division. Every Milton lot sets its own terms: the spare capacity in the electrical panel and the size of the water service the two units will share decide how much work a basement unit needs.

Milton’s housing is mostly single- and semi-detached houses built since the early 2000s, around mature neighbourhoods such as Old Milton. On a semi the side yard is often the only place a separate entrance can go, so the stair, guard and drainage are drawn to fit it, or the unit takes the escape-window route instead. We measure it on the first visit, whether the house is in Dorset Park or Mountainview.
The 2024 Building Code’s renovation rules for a second unit apply once a house has stood for five years. They allow a 30-minute fire separation between the units, and they let one unit’s exit pass through the other if an additional escape window is provided. Milton’s housing is mostly single and semi-detached houses built from the early 2000s on, so many basements qualify on age alone.
The exception is a house completed within the last five years on one of Milton’s newest streets. Its basement unit follows the rules for new construction instead, so we confirm the completion date from the original permit or the closing papers on the first visit, and the separation and exits we draw for the Town of Milton Building Division follow from that date.
Milton’s unit rules name the semi-link house and the townhouse alongside detached and semi-detached houses, as long as the lot has municipal water and sewer, and they leave out stacked and back-to-back townhouses. We confirm which type the house is before anything else, because the type decides whether a unit is allowed at all.
An inside townhouse shares both side walls, so its separate entrance has to go at the front or the back, and both households’ parking has to fit on the one driveway. We draw the entrance, the escape window and the parking together on the site plan, and the Town of Milton Building Division reviews them with the rest of the unit.
