  • The Town of Milton Building Division. Milton is a lower-tier municipality in Halton Region, which handles regional roads and servicing but not house permits. We submit under our own BCIN and P.Eng credentials and stay on the file until the permit is issued.

  • Milton has one. Milton’s Site Alteration By-law 094-2022 applies across the town, including residential lots, with exemptions for minor landscaping and driveway maintenance. Where it applies, the application needs a grading plan, and we prepare and file it.

  • Conservation Halton covers Milton. It regulates work near watercourses, valleys, wetlands and floodplains, and its permit comes before the Town of Milton Building Division issues the building permit. We check the regulated-area mapping for a Milton lot at the zoning stage.

  • All of it, including Old Milton, Timberlea, Dorset Park and Mountainview. Milton is within an hour of our Richmond Hill office, and the first consultation is free.

  • Online. The Town of Milton’s permit service is the Amanda Permit Portal: you set up an account there, start the application, and the Town of Milton Building Division reviews it. When we prepare your drawings, we start the application in Amanda on your behalf and work through the examiner’s comments with the Division until the permit comes through.

  • In Amanda. Once you log in, the portal lists each permit application you have made with its status, so you can follow the Building Division’s review without phoning the Town. On an application we filed, we watch that status for you and call when the examiner has questions or the permit is issued.

  • That depends on whether the lot is in Milton’s urban area or its rural area. Urban land is zoned under Zoning By-law No. 016-2014 and rural land under Zoning By-law No. 144-2003, two separate by-laws with their own zones and standards. We look up the by-law and the zone for your address first, because the Town of Milton Building Division checks the setbacks, height and coverage on our site plan against that by-law.

  • It depends on the lot more than on the tree. For a tree standing wholly on your own property, the Town of Milton’s advice is to have a certified arborist look at it before it comes down. If the property is larger than 0.5 hectares, or lies entirely within the Regional Greenlands System, Halton Region’s tree removal regulations have to be checked as well, since the Region sits above the Town and has rules of its own. We flag that from the survey before any work near trees is planned.

  • On an urban lot connected to municipal water and sewer, the house plus up to three additional residential units, with no more than one of them in a detached building. That covers detached, semi-detached and semi-link houses and townhouses, but not stacked or back-to-back townhouses. Where on the lot the units can go is then a question for the lot’s zone under By-law No. 016-2014, which we read before a unit is designed.

  • Yes, since January 2026, when the Town amended its Official Plan and zoning to allow additional units in the rural area. How many a property can have is set zone by zone, and rural zones come from By-law No. 144-2003 rather than the urban by-law. We check what your property’s rural zone permits before you plan around a unit.

  • Once a complete application is in, Ontario’s Building Code gives the municipality 10 business days to issue a house permit or refuse it with reasons. Larger and more complex buildings get a longer period. The count only starts when nothing is missing, so an absent sheet or an unresolved zoning issue holds it back. Fine Engineering checks zoning and code before anything is submitted.

  • The application form, the drawings the Building Code calls for, and every other approval the project depends on. Zoning counts as applicable law, so a needed minor variance has to be granted before the permit can be issued, and a lot in a conservation authority’s regulated area may need that authority’s permit first. Fine Engineering assembles the whole package, with the designer’s registration details on the drawings.

  • Most often because the plans do not show that the work meets the Building Code or applicable law, such as the zoning by-law. A permit is also withheld when the law requires an engineer’s or architect’s design and the drawings lack one, or when the builder of a new home is unlicensed. The refusal must state its reasons, and Fine Engineering revises the set to answer each one.

  • Stop work and start on the drawings. A stop-work order usually means construction began without a permit or departed from the approved plans. Getting out of it takes a permit application that shows what was built and what is proposed, then whatever inspections the city asks for. Fine Engineering prepares those drawings and replies to the city’s letters.

  • A municipal inspector visits at set stages to confirm the work matches the permit drawings and the Building Code, and nothing gets covered up until its stage has passed. Footings and framing are typical stages. The final inspection is the one that lets the permit close. On its own projects, Fine Engineering’s drawings are the set the inspector checks against.

  • It can be revoked, which has much the same effect. The Building Code Act lets the chief building official revoke a permit when work has not seriously begun within six months of issue, or has been halted for over a year. A permit whose inspections were never finished stays open on the property. Fine Engineering can draw what an old permit still needs so the city can close it.

Which Milton houses can add units

Milton’s urban rule lists the house forms that qualify: detached, semi-detached, semi-link and townhouse dwellings with municipal water and sewer. Stacked and back-to-back townhouses are not on the list, so the house type on a listing or a survey is the first thing we check.

A qualifying lot can hold four homes in all, one more than the Planning Act makes every municipality allow. Only one of the three added units may sit in a detached building: two units in the house plus one in the yard is allowed, while a unit in each of two yard buildings is not.

Trees on large Milton lots

Once a Milton lot passes 0.5 hectares, or lies wholly within the Regional Greenlands System, its trees come under Halton Region’s rules as well as the Town’s advice. That changes the order of work for an addition, a pool or a backyard unit: we plot the trees near the footprint from the survey, suggest an arborist look at any in the way, and check the regional rules before the layout is settled.
