  • The Town of Newmarket Building Division. Newmarket is a lower-tier municipality in York Region, which handles regional roads and servicing but not house permits. We submit under our own BCIN and P.Eng credentials and stay on the file until the permit is issued.

  • Yes. Newmarket regulates excavation, filling and regrading under its own by-law, separately from the building permit, so a pool, a walkout or a regraded yard can need its own application with a grading plan. We prepare and file it.

  • Lake Simcoe Region Conservation Authority (LSRCA) covers Newmarket. It regulates work near watercourses, valleys, wetlands and floodplains, and its permit comes before the Town of Newmarket Building Division issues the building permit. We check the regulated-area mapping for a Newmarket lot at the zoning stage.

  • All of it, including Historic Downtown, Glenway and Stonehaven. Newmarket is about half an hour from our Richmond Hill office, and the first consultation is free.

  • Most of Newmarket is zoned under Comprehensive Zoning By-law 2010-40, the Town’s parent by-law. The Urban Centres have a by-law of their own, 2019-06, and for land in the Oak Ridges Moraine area the Town sends owners to its Planning Department for zoning information. We pin down which one governs your lot first, because the Town of Newmarket Building Division reads every permit set against it.

  • Online, through the Town’s Development Portal, which takes the application form and the drawings for the Town of Newmarket Building Division. Zoning is checked as part of that review, so we test the design against By-law 2010-40, or 2019-06 in the Urban Centres, before anything is uploaded. If we drew the set, filing it is part of our job.

  • Yes. The Development Portal that took the application also shows its status, so you can see where it stands without calling the Town. Comments from the Town of Newmarket Building Division come to us, and we reply to each one and upload the revised sheets to the same file.

  • Usually, if the trunk is 20 cm or more across at 1.4 m above the ground. Newmarket’s Private Tree Protection By-law 2022-10 asks for a Private Tree Permit before a tree that size is destroyed, and before it is injured, which includes root damage from digging. The by-law exempts some trees, such as those under the Town’s Woodlot By-law or York Region’s Forest Conservation By-law. When a project would harm a protected tree, we raise the permit before the site plan goes to the Town of Newmarket Building Division.

  • Three, counting the house you have, under Newmarket’s By-law 2026-10. Both extra units can go inside the house, or one inside and one in a separate detached building, on a lot with a detached, semi-detached, link, row or townhouse dwelling. The by-law leaves some land out, including the Environmental Protection Open Space zone and floodplain the LSRCA has identified, so we check your lot against both before planning a unit.

  • We check the address against the Lower Main Street South Heritage Conservation District, the only district Newmarket has designated under Part V of the Ontario Heritage Act. It lies along Main Street, close to the town’s heritage homes, so those are the addresses most worth checking. If your house is inside it, we confirm with the Town what the designation expects of exterior work before the Town of Newmarket Building Division sees a permit set.

  • Once a complete application is in, Ontario’s Building Code gives the municipality 10 business days to issue a house permit or refuse it with reasons. Larger and more complex buildings get a longer period. The count only starts when nothing is missing, so an absent sheet or an unresolved zoning issue holds it back. Fine Engineering checks zoning and code before anything is submitted.

  • The application form, the drawings the Building Code calls for, and every other approval the project depends on. Zoning counts as applicable law, so a needed minor variance has to be granted before the permit can be issued, and a lot in a conservation authority’s regulated area may need that authority’s permit first. Fine Engineering assembles the whole package, with the designer’s registration details on the drawings.

  • Most often because the plans do not show that the work meets the Building Code or applicable law, such as the zoning by-law. A permit is also withheld when the law requires an engineer’s or architect’s design and the drawings lack one, or when the builder of a new home is unlicensed. The refusal must state its reasons, and Fine Engineering revises the set to answer each one.

  • Stop work and start on the drawings. A stop-work order usually means construction began without a permit or departed from the approved plans. Getting out of it takes a permit application that shows what was built and what is proposed, then whatever inspections the city asks for. Fine Engineering prepares those drawings and replies to the city’s letters.

  • A municipal inspector visits at set stages to confirm the work matches the permit drawings and the Building Code, and nothing gets covered up until its stage has passed. Footings and framing are typical stages. The final inspection is the one that lets the permit close. On its own projects, Fine Engineering’s drawings are the set the inspector checks against.

  • It can be revoked, which has much the same effect. The Building Code Act lets the chief building official revoke a permit when work has not seriously begun within six months of issue, or has been halted for over a year. A permit whose inspections were never finished stays open on the property. Fine Engineering can draw what an old permit still needs so the city can close it.

By-laws 2010-40 and 2019-06

Newmarket zones most land under Comprehensive Zoning By-law 2010-40 and its Urban Centres under a separate by-law, 2019-06, each with its own zones and numbers, so the first step on a Newmarket job is finding which one the lot falls under. In the Oak Ridges Moraine area the Town asks owners to get zoning details from its Planning Department instead, and we make that call before measuring a setback.

Extra units under 2026-10

Under By-law 2026-10 a Newmarket lot can hold the main home and two more units, and only one of those may be in a detached building. If you want a basement unit now and a backyard unit later, we lay out the first so the second still fits: the basement unit takes one of the two places, and the detached building stays open for the other.

Trees and the heritage district

By-law 2022-10 asks for a permit before a protected tree is injured as well as before it is cut down, so a footing, a trench or a regrade that cuts its roots can need a Private Tree Permit even when the tree stays. Inside the Lower Main Street South district, the Part V designation is a second matter to settle with the Town before exterior work is drawn. We raise both at the first visit.
