  • A building permit for the unit, applied for with drawings at Markham’s own building department rather than York Region. The stairwell for a new entrance changes the grade beside the house. Markham’s site alteration by-law is aimed at larger sites, and infill and additions go through the city’s RIGS grading review, so we confirm with the city which of the two, if either, covers a stairwell. We prepare and file the set and deal with the examiner’s comments.

  • Only where the lot is inside Toronto and Region Conservation Authority (TRCA) regulation, near a watercourse, a valley or a floodplain. Digging a stairwell down to the basement changes the grade there, and the TRCA permit may be needed before Markham issues the building permit. Markham’s unit rule also leaves out hazard lands the TRCA prescribes, so on those lots the mapping decides whether the unit is allowed at all. We read it before anything else.

  • Under Zoning By-law 2024-19, Markham permits additional residential units only on lots containing a detached, semi-detached or townhouse dwelling. No more than two can be located entirely within the house, and where an additional residential unit is located in an accessory building, only one is permitted in the house. Additional residential units are not permitted in a GWY1 zone or within hazard lands as prescribed by the Toronto Region Conservation Authority. So we check the zone first: in one of the excluded zones the unit is not allowed however well the basement measures up.

  • Yes. We take on legal basements across Markham, including Unionville and Thornhill, about half an hour from our Richmond Hill office. The first consultation is free, by phone or on site.

  • Three things to start: property address; basement ceiling height, measured floor to joist; and photos of the basement, the mechanical room and the outside wall where an entrance could go. Send those and we tell you what the City of Markham Building Standards Department will ask for before we quote.

  • Yes. Markham handles plans review in ePLAN, where the applicant logs in to read the examiner’s mark-ups and comments, and we send you each round with our answers. We revise the fire separation or exit details the examiner asks about and resubmit in the same portal until the Building Standards Department issues the permit.

  • It can. Digging a stairwell or a larger window well cuts roots, and Tree Preservation By-law 2023-164 requires a permit before a private tree 20 cm or more across, measured 1.37 m up, is injured, healthy or not, with City trees covered as well. We plot the trees from the survey and put the entrance on a side of the house that avoids them where the yard allows, and where it does not, we apply for the tree permit while the Building Standards Department reviews the unit.

  • That depends on what the district asks, so we find out before the entrance is drawn. Markham’s four heritage conservation districts take in Thornhill and Buttonville as well as the Unionville and Markham Village cores, and a new stairwell changes the outside of the house. We look at a side or rear position first, since either leaves the front as it is, and we settle what the district requires before the set goes into ePLAN.

  • Yes. We measure what was built, compare it with the Building Code and with Section 4.9.9 of By-law 2024-19, and draw the changes the unit still needs, such as a fire separation or a bigger bedroom window. The drawings go to the Building Standards Department as a new application on ePLAN, and the unit is inspected as that work is done.

  • Yes. We look the address up on the City’s interactive zoning map to see which by-law covers it, confirm the lot is outside a GWY1 zone and TRCA hazard lands, and walk the basement for headroom and a workable entrance.   • A legal basement is a basement apartment that meets the Building Code and the local zoning: a self-contained second unit with its own kitchen and bathroom. The code calls it a secondary suite, and Ontario’s planning rules call it an additional residential unit. Fine Engineering designs and permits these units across the GTA and coordinates the build.

  • At least 1.95 m, about 6 ft 5 in, under Ontario’s 2024 Building Code, with 1.85 m of clear height allowed under beams and ducts. The measurement runs from the finished floor to the finished ceiling, so new flooring and drywall count against it. Fine Engineering measures the height at the first site visit, before any layout is drawn.

  • It needs a safe way out, which is usually its own exterior door. In a house that has stood for five years or more, the 2024 Building Code’s renovation rules also accept an exit route through the other unit, as long as the suite gets an extra escape window that opens from inside without tools and the smoke alarms are linked. Fine Engineering works out which route suits the layout.

  • Yes. Once a house has a secondary suite, its smoke alarms must be interconnected, by wire or wirelessly, so one sets off the rest, and shared spaces need them too. A suite with a fuel-burning appliance, or one sharing a wall, floor or ceiling with such an appliance or a garage, also needs carbon monoxide alarms by its bedrooms. Fine Engineering marks every alarm on the permit set.

  • For many homeowners, yes. A legal second unit can earn rent and add property value, and because it was built under a permit, it avoids the trouble an unpermitted suite causes when the house is sold. The return depends on how much the basement needs, whether that is more headroom, a new exit or fire separation. Fine Engineering prices that work before any drawing starts.

  • Usually because the heat reaching the room does not match the heat it loses. A room over a garage, or one with more glass and outside wall, loses heat faster, and a long or undersized duct delivers less air than the room needs. A room-by-room heat-loss calculation and a duct design show where the gap is. Fine Engineering does both for existing houses as well as new ones.

Legal basement permits in Markham

In Markham the reviewer is the City of Markham Building Standards Department. Every Markham lot sets its own terms: the spare capacity in the electrical panel and the size of the water service the two units will share decide how much work a basement unit needs.

We walk the site with the survey, usually within a day or two of the call, before anything is drawn, then file the legal basements package to the City of Markham Building Standards Department’s own checklist.

Legal basement apartments in Unionville and Thornhill

Markham’s housing takes in heritage village cores in Unionville and Markham Village surrounded by 1980s to 2000s subdivisions and newer planned communities like Cornell. A visit in Milliken or Cornell starts with the headroom, since a ceiling under the height the Building Code sets means lowering the floor. The bedroom windows come next: one too small to escape through needs a bigger opening and a dug well.

A garden suite later changes the basement plan

Markham’s additional unit rules, in Section 4.9.9 of By-law 2024-19 as amended by By-law 2026-44, tie the house and the yard together. Two additional units can go inside the house, but once one sits in an accessory building such as a garden suite, the house is held to one.

So if a suite might come later, we draw the basement as the house’s only additional unit and keep the yard and the service route clear, rather than planning two units inside that would rule the suite out. Our broker can talk through which mix suits the property before anything is drawn.

Why the age of a Markham house matters for a second unit

The Building Code’s rules for existing houses give a second unit some allowances, including a lighter fire separation and an exit through the other unit when an extra escape window is added, but only in a house that has stood at least five years. Houses in Markham’s village cores and its 1980s to 2000s subdivisions are well past that.

Some houses in newer planned communities like Cornell may not be, and a house too young for the allowances is designed to the stricter rules for new construction. We confirm the year the house was built at the first visit, because it decides how the separation and exits are drawn for the Building Standards Department.
