(416) 990-9179It can. Milton’s by-law 094-2022 covers house lots as well, with exemptions for minor landscaping and driveway upkeep. Whether the levelling for a deck still counts as minor is the question, so we measure the grades at the site visit and check them against the exemption before anything goes to the Town of Milton Building Division.
Where the lot is in a regulated area, yes. Section 28 of the Conservation Authorities Act bars development in hazardous lands, wetlands, river or stream valleys and shorelines at risk of flooding or erosion unless the authority issues a permit, and building a deck there counts. We check Conservation Halton’s mapping first, since that permit comes ahead of the one from the Town of Milton Building Division.

The Town of Milton Building Division reviews the drawings, issues the permit and inspects the deck as it goes up. Halton Region is the upper tier above the Town, but house-scale permits like this one are not its job. We submit the application through the Town’s Amanda Permit Portal, and you can log in there to see where it stands.
That comes from your lot’s zoning, so we look it up first: Zoning By-law No. 016-2014 for a house in the urban area, or No. 144-2003 for a rural property. We take the side and rear setbacks for your zone from that by-law, measure them on your survey and size the deck to fit before the Town of Milton Building Division reviews it.
It can, since a footing dug into the roots can harm the tree. Before a tree standing wholly on your lot is removed, the Town of Milton recommends asking a certified arborist, and on a property over 0.5 hectares or wholly inside the Regional Greenlands System, Halton Region’s tree removal regulations come in too. We would rather move a footing or run a longer beam past the roots, and the footing plan filed through the Amanda Permit Portal shows where each one lands.
Yes. A roof turns the deck into a covered porch and adds load the deck never carried, so the posts, beams and footings are sized for it and the roof is tied into the wall of the house, all on drawings for the Town of Milton Building Division. Before any of that, we check the roofed structure against your zone’s setbacks and lot coverage in Zoning By-law No. 016-2014.
Only if they are sound. We open the ledger where the old deck meets the house to check the framing behind it, and dig beside the footings to see their size and depth before reusing any. A replacement that grows past the old deck’s footprint or height is a new design, so it goes back through the setbacks in By-law No. 016-2014 and onto a new permit application with the Town of Milton Building Division.
Yes. We prepare the footing, framing and guard drawings, file them through the Amanda Permit Portal and answer the Town of Milton Building Division’s comments, and your contractor builds from the issued set. The Town’s inspectors check the deck against those drawings, so a change on site comes back to us to revise before it is built.

Not covered here? Book a free consultationUsually, yes. Each municipality sets its own line. The GTA rules we work with go by the deck’s height above the ground, and some also count any deck fastened to the house. A roofed porch fastened to the house needs one under each of them. Cities word the rule differently, so Fine Engineering checks your municipality’s own wording before a deck is drawn.
Start with drawings and, in most cases, a permit, then build from the ground up. Once the permit is issued, call for utility locates, dig the footings to the depth your soil needs and call in each inspection the permit lists as that stage is reached. Then come the framing, the decking, the guards and stairs, and the final inspection. Fine Engineering draws and builds decks across the GTA.
As part of the deck, on the same permit drawings. The stringers are cut to the drawing and fastened to the deck framing, and the guard rule that applies to the deck applies to the open sides of the stair too. Fine Engineering draws the stair, its stringers and its guard on the permit set.
Either the main roof carries down over the porch, or a lower shed roof hangs off the house wall. Both put new roof and snow load on the house, so the join needs flashing and the existing wall and roof framing has to carry it. Fine Engineering checks that framing before the porch roof is drawn.
For a permit, the zoning by-law decides. Zoning is applicable law, so a permit is only issued for work that complies with it. If a covered porch would take the lot past what its by-law allows, the owner makes the porch smaller or gets a minor variance first. Fine Engineering reads the by-law for your lot, including how it treats a roofed porch, before the porch is drawn.
Most often because water crosses a property line, the ground slopes too gently away from the house, or the swales and elevations do not tie into the survey. Reviewers also return plans that lack erosion control, or an engineer’s stamp where one is required. Fine Engineering designs grading to each municipality’s own criteria and revises the plan to answer the reviewer’s comments.

In Milton the reviewer is the Town of Milton Building Division. Every Milton lot sets its own terms: the height above grade, the wall the deck fastens to and the soil under the footings decide the design before anything is dug.

Most housing in Milton is single- and semi-detached houses built since the early 2000s, around mature neighbourhoods such as Old Milton. A newer house with a walkout basement can put the deck well above the yard, so its posts, bracing and stairs are drawn for that height. On a semi-detached house the deck can run to the shared lot line, so the zoning decides how close it may come.
The site plan comes first, drawn from your survey with the deck’s distance to each lot line under Zoning By-law No. 016-2014, or No. 144-2003 on a rural lot. A footing plan follows. The 2024 Building Code ties footing depth to the soil, and in clay a footing under an unheated structure goes at least 1.2 m down unless a foundation design supports less, so our P.Eng sets the depth from what is under your yard.
The framing sheet gives the beams, joists, spans and the ledger connection to the house. Guards are drawn wherever the deck sits more than 600 mm above the ground within 1.2 m of it: at least 900 mm high up to 1,800 mm above finished ground, and 1,070 mm above that. The whole set goes up through the Amanda Permit Portal, and the Town’s inspectors check the finished deck against it.
If your house has a basement unit, or may get one under Milton’s rules for additional units on serviced lots, its entrance stair or escape window may sit right where a rear deck would go. Planning the deck and the unit together keeps one from blocking the other.
Where the unit relies on an escape window, its window well needs at least 1,000 mm clear in front of the window, and a deck built over or beside the well cannot take that space. We draw the deck around the well and the entrance stair, so the Town of Milton Building Division reviews one layout that keeps the unit’s way out open.
