  • The City of Burlington Building Department. Burlington is a lower-tier municipality in Halton Region, which handles regional roads and servicing but not house permits. We submit under our own BCIN and P.Eng credentials and stay on the file until the permit is issued.

  • Burlington has one. Burlington’s Site Alteration By-law 064-2014 can require a permit on a residential lot for a pool, regrading or infilling the yard, a patio or a retaining wall. Where it applies, the application needs a grading plan, and we prepare and file it.

  • Conservation Halton covers Burlington. It regulates work near watercourses, valleys, wetlands and floodplains, and its permit comes before the City of Burlington Building Department issues the building permit. We check the regulated-area mapping for a Burlington lot at the zoning stage.

  • All of it, including Aldershot, Downtown Burlington, Millcroft and Alton Village. Burlington is within an hour of our Richmond Hill office, and the first consultation is free.

  • By email. Burlington has no online portal for building permits, so the drawings and application forms go to buildingpermits@burlington.ca as a single electronic submission. When we prepare your drawings, we assemble that package, send it to the City of Burlington Building Department and answer the examiner’s comments until the permit is issued.

  • You phone the City. The myfiles tracker on Burlington’s site follows Pre-Building Approval applications only, and the City treats those as a separate process, so a building permit file does not show up there. On an application we sent in, we make the calls and let you know when the Building Department has comments or has issued the permit.

  • That depends on where the lot is. Residential Zoning By-law 09-2026 covers the residential zones mapped on its Schedule A, Zoning By-law 2020 still governs the rest of the city, and land inside the Niagara Escarpment Commission area takes its zoning from the NEC. We look the address up on Schedule A before anything is drawn, because the Building Department checks the permit set against whichever of the three applies.

  • Inside the Urban Planning Area Boundary, yes, for any private tree whose trunk is 20 cm or more across at 1.37 m above the ground, and Private Tree By-law 040-2022 treats injuring that tree the same way as cutting it down. Heritage trees and endangered, threatened or at-risk species have protection too. The by-law ends at the urban boundary, so for one of the few rural houses in the north we check separately what governs its trees.

  • The house and as many as three additional residential units, under section 5.14 of By-law 09-2026, in zones that allow a detached or semi-detached house, a street townhouse or a rear lane townhouse. No more than two of the added units can be detached, and those two have to share one accessory building. The section is written for urban residential land, so we confirm the lot qualifies before a unit is designed.

  • We check the address against the Burlington Avenue-Ontario Street Heritage Conservation District, which Council created in March 2026 through By-law 08-2026 under Part V of the Ontario Heritage Act. The district is new, so a design or an approval from before then may not take it into account. For a house inside the boundary, we find out what the district asks of exterior work before the elevations go to the Building Department.

  • Once a complete application is in, Ontario’s Building Code gives the municipality 10 business days to issue a house permit or refuse it with reasons. Larger and more complex buildings get a longer period. The count only starts when nothing is missing, so an absent sheet or an unresolved zoning issue holds it back. Fine Engineering checks zoning and code before anything is submitted.

  • The application form, the drawings the Building Code calls for, and every other approval the project depends on. Zoning counts as applicable law, so a needed minor variance has to be granted before the permit can be issued, and a lot in a conservation authority’s regulated area may need that authority’s permit first. Fine Engineering assembles the whole package, with the designer’s registration details on the drawings.

  • Most often because the plans do not show that the work meets the Building Code or applicable law, such as the zoning by-law. A permit is also withheld when the law requires an engineer’s or architect’s design and the drawings lack one, or when the builder of a new home is unlicensed. The refusal must state its reasons, and Fine Engineering revises the set to answer each one.

  • Stop work and start on the drawings. A stop-work order usually means construction began without a permit or departed from the approved plans. Getting out of it takes a permit application that shows what was built and what is proposed, then whatever inspections the city asks for. Fine Engineering prepares those drawings and replies to the city’s letters.

  • A municipal inspector visits at set stages to confirm the work matches the permit drawings and the Building Code, and nothing gets covered up until its stage has passed. Footings and framing are typical stages. The final inspection is the one that lets the permit close. On its own projects, Fine Engineering’s drawings are the set the inspector checks against.

  • It can be revoked, which has much the same effect. The Building Code Act lets the chief building official revoke a permit when work has not seriously begun within six months of issue, or has been halted for over a year. A permit whose inspections were never finished stays open on the property. Fine Engineering can draw what an old permit still needs so the city can close it.

Burlington’s two zoning by-laws

Zoning By-law 2020 was repealed only for the residential zones that By-law 09-2026 took over in March 2026, so it still applies to the rest of Burlington outside the escarpment area. An older survey or permit set for a house can quote 2020 rules that no longer govern it. Before we draw, the address is placed on Schedule A, and setbacks and height come from the by-law that now applies.

Detached units in Burlington

Burlington goes past the Planning Act minimum of three units on a lot: the house can add three units of its own, and two of them can be detached. A parcel may hold only one accessory building with detached units in it, though. Two separate backyard buildings with a unit in each will not pass, but one building holding both units can, and we plan its size and position on the lot with that limit in mind.
