  • The City of Kitchener Building Division. Kitchener is a lower-tier municipality in Region of Waterloo, which handles regional roads and servicing but not house permits. We submit under our own BCIN and P.Eng credentials and stay on the file until the permit is issued.

  • Yes. Kitchener regulates excavation, filling and regrading under its own by-law, separately from the building permit, so a pool, a walkout or a regraded yard can need its own application with a grading plan. We prepare and file it.

  • Grand River Conservation Authority (GRCA) covers Kitchener. It regulates work near watercourses, valleys, wetlands and floodplains, and its permit comes before the City of Kitchener Building Division issues the building permit. We check the regulated-area mapping for a Kitchener lot at the zoning stage.

  • All of it, including Doon Pioneer Park, Stanley Park, Victoria Park and Westmount. Kitchener is within ninety minutes of our Richmond Hill office, and the first consultation is free.

  • Through the City’s online services portal, which runs on AMANDA and takes the forms and drawings for the City of Kitchener Building Division. The review tests the design against the zoning, so before anything is uploaded we find out whether By-law 2019-051 or By-law 85-1 covers the lot. When we prepare the drawings, we make the application as well, and the examiner’s questions come to us.

  • In the portal you applied through. After submission it shows where the review stands, keeps the permit drawings and documents on file, and is where inspections are booked once work starts. A lot that also needs a Grand River Conservation Authority permit has a second file with the GRCA, and we follow both until each one is issued.

  • One of two. By-law 2019-051 is the newer one and zones roughly four in five properties in the city, and By-law 85-1 still governs the remainder. The City expects owners to settle which one applies before a permit application goes in, so we look it up for your address first. The City of Kitchener Building Division then reviews the drawings against that by-law.

  • Only on a large lot. Chapter 692 of the Municipal Code, Kitchener’s private tree by-law, applies to private properties bigger than one acre (0.405 hectares), and there it protects any tree with a trunk 10 cm or more across. Taking one of those down can need a tree conservation permit. A house lot of an acre or less is outside the by-law, but we still mark the trees near the work on the site plan the City of Kitchener Building Division receives.

  • Up to four, on a residential lot zoned for a single detached, semi-detached or street townhouse dwelling. The extra units can go inside the house, in an addition to it, or in a detached backyard home that holds one or two. Lot width, servicing or a natural hazard can hold some lots to one or two units, so we test those limits before a layout goes to the City of Kitchener Building Division.

  • Only if it sits inside one of the four the City has designated under Part V of the Ontario Heritage Act, which are St. Mary’s, Upper Doon, Victoria Park and Civic Centre. Victoria Park is a neighbourhood name too, and a Doon address is not automatically in Upper Doon, so we check the property against the district boundary rather than the name. Inside a district, we ask the City what it expects of exterior work before the elevations are drawn.

  • Once a complete application is in, Ontario’s Building Code gives the municipality 10 business days to issue a house permit or refuse it with reasons. Larger and more complex buildings get a longer period. The count only starts when nothing is missing, so an absent sheet or an unresolved zoning issue holds it back. Fine Engineering checks zoning and code before anything is submitted.

  • The application form, the drawings the Building Code calls for, and every other approval the project depends on. Zoning counts as applicable law, so a needed minor variance has to be granted before the permit can be issued, and a lot in a conservation authority’s regulated area may need that authority’s permit first. Fine Engineering assembles the whole package, with the designer’s registration details on the drawings.

  • Most often because the plans do not show that the work meets the Building Code or applicable law, such as the zoning by-law. A permit is also withheld when the law requires an engineer’s or architect’s design and the drawings lack one, or when the builder of a new home is unlicensed. The refusal must state its reasons, and Fine Engineering revises the set to answer each one.

  • Stop work and start on the drawings. A stop-work order usually means construction began without a permit or departed from the approved plans. Getting out of it takes a permit application that shows what was built and what is proposed, then whatever inspections the city asks for. Fine Engineering prepares those drawings and replies to the city’s letters.

  • A municipal inspector visits at set stages to confirm the work matches the permit drawings and the Building Code, and nothing gets covered up until its stage has passed. Footings and framing are typical stages. The final inspection is the one that lets the permit close. On its own projects, Fine Engineering’s drawings are the set the inspector checks against.

  • It can be revoked, which has much the same effect. The Building Code Act lets the chief building official revoke a permit when work has not seriously begun within six months of issue, or has been halted for over a year. A permit whose inspections were never finished stays open on the property. Fine Engineering can draw what an old permit still needs so the city can close it.

Two zoning by-laws in Kitchener

Kitchener’s zoning is split between two documents. Most properties are under By-law 2019-051, but about a fifth are still under By-law 85-1, and each sets its own limits for setbacks, height and lot coverage. Our zoning review names the by-law for the address before anything else, and every limit on the site plan is then taken from that one.

Kitchener’s four-unit rule

Ontario’s minimum is three units on a serviced urban lot. Kitchener allows four where the zoning permits a single detached, semi-detached or street townhouse dwelling, with added units inside the house, in an addition, or in a backyard home of one or two units. A narrow lot, limited servicing or a natural hazard can cut that to one or two, so we check for each before drawing.

Heritage districts in Kitchener

Kitchener’s four Part V districts are St. Mary’s, Upper Doon, Victoria Park and Civic Centre. For a house inside one, a new porch, an addition or new windows on the front change what the street sees, so we confirm with the City what the district asks of that work before the elevation is drawn. The zoning and Building Code review by the Building Division still applies on top.
