  • To Oakville. The application goes to the Town of Oakville Building Department, not Halton Region, as a new building on your lot with a drawing set of its own. Oakville has a site alteration by-law, so we confirm with the Town whether the suite’s excavation falls under it or is covered by the building permit. We draw the suite, file it and answer the examiner’s comments until the permit is issued.

  • Only where the yard falls inside the regulated area of Conservation Halton: a creek valley, a wetland or a shoreline at risk of flooding or erosion. Section 28 of the Conservation Authorities Act prohibits development there without the authority’s permit, and a new suite counts. We check Conservation Halton’s mapping for your lot.

  • Under Oakville’s Zoning By-law 2014-014, attached additional residential units are permitted in detached, semi-detached, linked and townhouse dwellings, and detached additional residential units are permitted in an accessory building associated with those dwellings. A property may have a maximum of two attached additional residential units, or one attached unit and one detached unit.

  • Yes, and two kinds of tree count. Oakville’s Private Tree Protection By-law 2017-038 requires a permit before you injure or remove a tree on private property with a trunk diameter of 15 centimetres or more at breast height, or a tree that must be kept or planted under an approved site plan. Where an approved site plan covers the lot, we read it with the survey.

  • Yes. We take on garden suites across Oakville, including Old Oakville and Bronte, within an hour of our Richmond Hill office. The first consultation is free, by phone or on site.

  • Three things to start: property address and a survey, if you have one; whether the suite is for family or rent; and photos of the backyard and the side-yard access. Send those and we tell you what the Town of Oakville Building Department will ask for before we quote.

  • Possibly, but the answer comes from a different by-law than south of Dundas. The detached-unit rule we usually cite is section 4.1.2 of Zoning By-law 2014-014, and that by-law does not cover the band between Dundas and the highway, where most of the 2000s neighbourhoods north of Dundas are; those lots are under Zoning By-law 2009-189. For them we take the suite’s setbacks, height and accessory building limits from 2009-189 before anything is drawn.

  • We find out what the district requires before the suite is sized. Trafalgar Road and Old Oakville are two of the Town’s four heritage conservation districts, with First and Second Street and Downtown Oakville, and a new building in the rear yard can be held to the district’s requirements on top of the zoning. Once the Town has told us what applies, we draw the suite’s height, roof and cladding to suit and file the set with the Town of Oakville Building Department.

  • We submit it through the Town’s Online Services, and because the suite is a new building, the set reviewed in ePlan carries a site plan with its setbacks, the route for water, sewer and power, and the grading around it, as well as the floor plans and structure. Comments come back through ProjectDox, and we revise and resubmit there until the Town of Oakville Building Department issues the permit.

  • It can. Under section 4.1.2 of Zoning By-law 2014-014 the detached unit goes in an accessory building that belongs with the house, and a detached garage is one, so a suite built in or above it counts as the lot’s one detached unit. Our P.Eng first looks at whether the garage’s footings and walls, built only for a garage, can take living space or a floor above, and we measure any extra height against the by-law for the lot.

  • That comes down to the rear yard, which we measure against the zoning first. We take the setbacks and height from the by-law for the lot, which south of Dundas is Zoning By-law 2014-014, plot every private tree 15 cm or more across at breast height from the survey, and look for a side yard wide enough to carry the services to the back. The suite fits where all three leave room.

  • A garden suite is a self-contained home in the backyard of a house, detached from the main building, with its own kitchen, bathroom and entrance. Local by-laws set its size, setbacks and height, and those rules differ from one municipality to the next. Fine Engineering measures a lot against them at the start of every garden suite project.

  • There is no single figure. A garden suite is priced like a small house, and the lot then moves the total up or down through the length of the service run from the house and how easily machines can reach the yard. Fine Engineering prices each suite from a written scope after the zoning check, and the first consultation is free.

  • Most often because water crosses a property line, the ground slopes too gently away from the house, or the swales and elevations do not tie into the survey. Reviewers also return plans that lack erosion control, or an engineer’s stamp where one is required. Fine Engineering designs grading to each municipality’s own criteria and revises the plan to answer the reviewer’s comments.

  • Within limits the municipality sets. Its lot grading criteria give a minimum slope, so water runs away from the house, and a maximum, beyond which the change in level needs a retaining wall.   • The measures that keep soil on a site during construction: silt fence along the boundaries, a mud mat at the driveway, protection over catch basins and cover on stockpiles. Municipalities often make them a condition of a grading or site alteration approval and inspect for them. Fine Engineering puts erosion and sediment control on every grading plan it draws.

  • Often, yes. A tall retaining wall, or one that holds up a driveway, a building or a neighbour’s yard, generally needs a building permit and an engineered design, and a wall that changes the grade can also need a site alteration permit. Low garden walls usually do not. Fine Engineering confirms the height that triggers a permit on the site, then designs the wall and the grading around it.

In Oakville the reviewer is the Town of Oakville Building Department. Every Oakville lot sets its own terms: rear-yard depth, setbacks, height limits, tree protection and the route for water, sewer and power decide whether a suite fits.

Backyard garden suites in Old Oakville and Bronte

Oakville’s housing takes in lakefront and older Oakville lots being rebuilt, 1980s Glen Abbey subdivisions and 2000s neighbourhoods north of Dundas. A lakefront yard can reach into shoreline hazard mapping, which is settled before any design. Elsewhere a lot being rebuilt is the easiest time to add a suite, with the services and the grading planned for both buildings at once.

Service trenches and Oakville’s tree by-law

A garden suite takes its water, sewer and power from the house, and the trench across the yard can cut roots as surely as a foundation. Oakville’s Private Tree Protection By-law 2017-038 requires a permit for injuring a protected tree as well as for removing it, so a trench through the roots of a private tree 15 cm or more across at breast height needs one first.

We route the trench around those trees where the yard allows and draw it on the site plan beside the suite, so the tree question is answered in the same set the Town of Oakville Building Department reviews.

Spacing and lot coverage for an Oakville garden suite

Ontario’s regulation for additional units sets two baselines on an urban residential lot: a building holding a unit stands at least 4 m from any other building on the lot that holds one, and buildings may cover up to 45 per cent of the lot. An Oakville by-law can relax either one, so we read them against Zoning By-law 2014-014 or 2009-189, whichever covers the address.

The gap from the house sets the front edge of the suite and the rear setback sets the back, and on a shallow yard there may be little room between them. We draw both lines on your survey first and size the suite to what is left, before the set goes to the Town of Oakville Building Department.
