  • To Kitchener. The application goes to the City of Kitchener Building Division, not the Region of Waterloo, as a new building on your lot with a drawing set of its own. Kitchener has a site alteration by-law, so we confirm with the city whether the suite’s excavation falls under it or is covered by the building permit. Kitchener also has two zoning bylaws in force, the newer 2019-051 for most lots and 85-1 for the rest, and the suite’s setbacks and height come from whichever covers yours.

  • If the backyard runs toward a river or stream valley, it may. Ontario’s regulation measures a stable valley to the top of its bank plus 15 metres, and building a suite inside that line needs a GRCA permit. Natural hazards are also among the limits Kitchener puts on a lot’s unit count, so the same mapping can lower how many units the lot takes.

  • Kitchener’s zoning bylaw permits up to four dwelling units on residential lots that allow a single detached, semi-detached or street townhouse dwelling, and an additional dwelling unit can be inside or added to the main building or in a detached backyard home of one or two units, though lot width, servicing or natural hazards may limit some lots to one or two units.

  • Only on a large lot. Kitchener’s private tree bylaw (Chapter 692, enacted by By-law 2010-042) protects trees 10 cm or more in diameter on private lots larger than one acre (0.405 hectares), and removing one of those trees may need a tree conservation permit. On a smaller lot this by-law puts no limit on where the suite goes.

  • Yes. We take on garden suites across Kitchener, including Doon Pioneer Park and Stanley Park, within ninety minutes of our Richmond Hill office. The first consultation is free, by phone or on site.

  • Three things to start: property address and a survey, if you have one; whether the suite is for family or rent; and photos of the backyard and the side-yard access. Send those and we tell you what the City of Kitchener Building Division will ask for before we quote.

  • Yes. Kitchener counts a detached backyard home of one or two units toward the lot’s limit of four, so a suite can be split into two homes. The two need a fire separation between them and an entrance each, and the drawings for the City of Kitchener Building Division show both. Before sizing a two-unit suite we check the lot’s width and servicing, since either can hold a Kitchener lot to one or two units in all.

  • It can, and it then counts as the lot’s backyard home. Our P.Eng first checks whether footings and walls built for a garage can carry living space or a second floor, which a garage foundation was not designed for. The setbacks and height the converted building must meet come from zoning bylaw 2019-051 or 85-1, whichever covers your lot, and both go on the set filed with the City of Kitchener Building Division.

  • Ontario’s O. Reg. 299/19 starts from 4 m between the suite and any other building on the lot holding a unit, and lets buildings cover up to 45 per cent of the lot. A zoning bylaw may allow a smaller gap or more coverage, so we read whichever of Kitchener’s two, 2019-051 or 85-1, covers your address. That gap and the rear setback fix where the suite can go before the City of Kitchener Building Division sees it.

  • It could, because Kitchener can hold a lot to one or two units when its services will not support more. A suite usually takes its water and sewer from the house, so we check the size of the water service and the sewer connection before the suite is sized, then route the trench along a side yard. The trench and both connections are drawn on the site plan the City of Kitchener Building Division reviews.

  • Yes. Under O. Reg. 299/19 anyone may live in an additional unit, whether or not they are related to you or own the lot, so a Kitchener backyard home can be let as soon as it is finished. The City of Kitchener Building Division reviews a rental suite against the same rules as one for family.   • A garden suite is a self-contained home in the backyard of a house, detached from the main building, with its own kitchen, bathroom and entrance. Local by-laws set its size, setbacks and height, and those rules differ from one municipality to the next. Fine Engineering measures a lot against them at the start of every garden suite project.

  • There is no single figure. A garden suite is priced like a small house, and the lot then moves the total up or down through the length of the service run from the house and how easily machines can reach the yard. Fine Engineering prices each suite from a written scope after the zoning check, and the first consultation is free.

  • Most often because water crosses a property line, the ground slopes too gently away from the house, or the swales and elevations do not tie into the survey. Reviewers also return plans that lack erosion control, or an engineer’s stamp where one is required. Fine Engineering designs grading to each municipality’s own criteria and revises the plan to answer the reviewer’s comments.

  • Within limits the municipality sets. Its lot grading criteria give a minimum slope, so water runs away from the house, and a maximum, beyond which the change in level needs a retaining wall.   • The measures that keep soil on a site during construction: silt fence along the boundaries, a mud mat at the driveway, protection over catch basins and cover on stockpiles. Municipalities often make them a condition of a grading or site alteration approval and inspect for them. Fine Engineering puts erosion and sediment control on every grading plan it draws.

  • Often, yes. A tall retaining wall, or one that holds up a driveway, a building or a neighbour’s yard, generally needs a building permit and an engineered design, and a wall that changes the grade can also need a site alteration permit. Low garden walls usually do not. Fine Engineering confirms the height that triggers a permit on the site, then designs the wall and the grading around it.

In Kitchener the reviewer is the City of Kitchener Building Division. Every Kitchener lot sets its own terms: rear-yard depth, setbacks, height limits, tree protection and the route for water, sewer and power decide whether a suite fits.

Kitchener’s housing has older homes around the core and Victoria Park with postwar and newer suburban subdivisions in Doon and Huron. Victoria Park is also a heritage conservation district, so a suite behind a house there starts with a heritage check; in the subdivisions, the yard depth against the setbacks decides it.

Planning a suite and a basement unit on one Kitchener lot

A Kitchener lot zoned for a detached, semi-detached or street townhouse dwelling can reach four units, placed in the house, in an addition to it or in the backyard home. Because the four are shared between buildings, the order matters: a basement unit built first still leaves the suite room for one unit or two within that total.

Each unit gets its own permit from the City of Kitchener Building Division when it is built, but the first set can already show where the second one goes. We size the water service and sewer connection for both at that point, so the later unit does not mean digging up the yard twice.

The suite goes in through the City’s online services portal, built on AMANDA, as a new building with its own set: a site plan with the setbacks, the gap from the house and the service trench, then floor plans, elevations and the structure.
