  • The Town of Oakville Building Department reviews it as a building permit application, with or without construction. Halton Region is the upper tier and plays no part in the permit itself. Oakville also has a site alteration by-law, so a job that regrades the lot for parking or a patio can need a second permit with a grading plan.

  • Only when the work reaches regulated land near a watercourse, valley, wetland or floodplain in Oakville, which Conservation Halton maps. Ontario Regulation 41/24 counts site grading, moving fill and building or enlarging a structure as development activity, so the trigger for a commercial job is outside work: a patio, an addition or new parking. Where it applies, the Conservation Halton permit comes before the building permit.

  • Yes. Oakville building permit applications are submitted through the Town’s Online Services. Applications that need drawings are reviewed in ePlan, powered by ProjectDox, where applicants sign in with their Town of Oakville account to see project tasks and status. We watch the status there and answer examiner comments as they come in, at no extra charge.

  • Yes. We take on commercial permits across Oakville, including Old Oakville and Bronte, within an hour of our Richmond Hill office. The first consultation is free, by phone or on site.

  • Three things to start: unit address and the landlord’s base-building drawings, if any; what the space was used for before, and what you plan; and your lease start date and any landlord deadlines. Send those and we tell you what the Town of Oakville Building Department will ask for before we quote.

  • Several approvals, of which the building permit is one. Once we have confirmed under By-law 2014-014 or 2009-189 that a restaurant is allowed at the address, the fit-out and the change of use go to the Town of Oakville Building Department through Online Services and ePlan. Health approval for the kitchen, a sign permit and, if you serve alcohol, a liquor licence are separate approvals; we take care of the building permit and tell you which of the rest your plans need.

  • We start with the address, because it decides the by-law: 2009-189 between Dundas Street and Highway 407, 2014-014 elsewhere in Oakville. Then we read that zone’s permitted uses and set your business against the last permitted use of the unit. If yours is not listed, we set out the options, a minor variance or a rezoning, before the lease is signed and before anything goes to the Building Department.

  • Yes, with the district’s rules settled first. Downtown Oakville is one of the town’s four heritage conservation districts, alongside Old Oakville, First and Second Street and Trafalgar Road, and a new shopfront or sign there is an exterior change the district has a say in. We draw the elevations to its rules and then file the fit-out with the Building Department in ePlan.

  • It can. By-law 2017-038 covers trees on private commercial land as well as house lots, and a property built under site plan approval may have trees the plan says must be kept, which are protected at any size. Digging for a patio, more parking or a new service line can injure one, so the trees go on our site plan from the survey and any conflict is raised before the Building Department sees the layout.

  • Yes. You can open the project in ePlan by signing in with your Town of Oakville account, and we start by reading its outstanding tasks and the examiner’s comments with you. Then we redraw the flagged sheets under our own BCIN and P.Eng credentials, check the use against By-law 2014-014 or 2009-189 where a comment turns on zoning, and resubmit in ePlan for the Building Department.

  • Yes. Our fire-safety drawings cover the alarm layout, emergency lighting and exit signs, and sprinklers where the new occupancy needs them. They go into ePlan with the change of use drawings, so the Town of Oakville Building Department reviews the systems and the layout as one set.

  • Only where the zoning allows the new use, or after a minor variance or a rezoning, because a building permit can only be issued for work that meets applicable law and zoning is part of it. The conversion is then a change of use permit, often with accessibility, exit and fire-separation upgrades. Fine Engineering checks the zoning before anything is drawn.

  • No. A building permit covers construction and changes of use under the Building Code Act. A business licence is a separate municipal approval to operate, and which businesses need one depends on the municipality and the type of business. A restaurant is a different occupancy from an office, so the switch needs a change of use permit before any fit-out starts, and the kitchen exhaust, plumbing and fire separations go on the same application.   • It is the building permit for work on a commercial building or unit: a tenant fit-out, an alteration, an addition or a new building. In Oakville the reviewer is the Town of Oakville Building Department. Every Oakville lot sets its own terms: the previous use of the unit, the base building’s fire separations and exits and the landlord’s own drawings decide how much the permit set has to cover.

Change of use across Old Oakville and Bronte

Oakville runs to lakefront and older Oakville lots being rebuilt, 1980s Glen Abbey subdivisions and 2000s neighbourhoods north of Dundas. A house on an established street that becomes an office or a clinic is a change of use, and the zoning for that street is read before anything else, since a permit can only be issued for a use the by-law allows there.

Commercial units between Dundas and the 407

A unit between Dundas Street and Highway 407 is zoned under By-law 2009-189, and one by the lake or north of the 407 under 2014-014. Each by-law sets its own zones, permitted uses and parking rules, so a change of use is read against the one for the address. A new use can need more parking than the old one as well as a new permission, and we check both before you commit to the unit.

Older Oakville buildings and the Fire Code

Two sets of rules apply when an older Oakville building changes use. The Building Department reviews the drawings for the work being permitted, while the Ontario Fire Code sets minimum safety standards for the building that already exists, which the owner must meet and the fire department enforces. In Downtown Oakville and the other heritage districts, we measure the existing exits and fire separations before the new layout is drawn.
