  • The City of Kitchener Building Division reviews it as a building permit application, with or without construction. The Region of Waterloo is the upper tier and plays no part in the permit itself. Kitchener also has a site alteration by-law, so a job that regrades the lot for parking or a patio can need a second permit with a grading plan.

  • Only when the work reaches regulated land near a watercourse, valley, wetland or floodplain in Kitchener, which Grand River Conservation Authority (GRCA) maps. Ontario Regulation 41/24 counts site grading, moving fill and building or enlarging a structure as development activity, so the trigger for a commercial job is outside work: a patio, an addition or new parking. Where it applies, the GRCA permit comes before the building permit.

  • Yes. Residents can apply for a Kitchener building permit through the City’s online services portal, and after applying they can use the same portal to check permit status, view permit drawings and documents, and book inspections. We can book the fit-out inspections there too, timed to the contractor’s schedule and your opening date.

  • Yes. We take on commercial permits across Kitchener, including Doon Pioneer Park and Stanley Park, within ninety minutes of our Richmond Hill office. The first consultation is free, by phone or on site.

  • Three things to start: unit address and the landlord’s base-building drawings, if any; what the space was used for before, and what you plan; and your lease start date and any landlord deadlines. Send those and we tell you what the City of Kitchener Building Division will ask for before we quote.

  • We answer that before anything is drawn, by reading the permitted uses for the unit’s zone in whichever by-law covers it, 2019-051 or the older 85-1. If the use is not listed, a planning approval has to come first, and the City of Kitchener Building Division cannot issue the permit until it does. It is worth knowing before the lease is signed, and we check it as part of the free consultation.

  • The building permit covers the kitchen, the seating, the exits and the change of use, and we file it with the City of Kitchener Building Division through the online services portal once the zoning shows a restaurant is allowed at the address. Health approval, a fire inspection, a sign permit and, where alcohol is served, a liquor licence are separate approvals from other offices. We work out the occupant load and exits once and use the same figures for every review.

  • For outside work, it can. A new sign, a changed storefront or an addition on a property in St. Mary’s, Upper Doon, Victoria Park or Civic Centre changes what the street sees, so we confirm with the City what the district asks of it. Work that stays inside the unit is mainly a matter for the City of Kitchener Building Division’s zoning and Building Code review, so we sort the job into inside and outside work before drawing.

  • No. The four-unit allowance is for residential lots where a detached, semi-detached or street townhouse dwelling is permitted. Housing above a Kitchener storefront is a question for the commercial zone in By-law 2019-051 or 85-1, and if the zone lists it, we draw the conversion as a change of use for the City of Kitchener Building Division, with a fire separation between the shop and the homes and exits for each.

  • When the Professional Engineers Act reserves the design for an engineer, because the Building Code Act then bars the permit without one. In a Kitchener unit that tends to mean structure, such as a new opening in a bearing wall, a mezzanine or rooftop equipment on an existing roof. Our P.Eng stamps those sheets in-house, and they go to the City of Kitchener Building Division through the portal with the rest of the set.

  • If the property is larger than one acre, yes. Chapter 692 reaches private lots over that size and protects their trees of 10 cm or more in diameter, so clearing some of them for parking can need a tree conservation permit. Regrading for the parking area also falls under Kitchener’s site alteration by-law, and we count the trees and the cut and fill before the site plan goes to the City.

  • Only where the zoning allows the new use, or after a minor variance or a rezoning, because a building permit can only be issued for work that meets applicable law and zoning is part of it. The conversion is then a change of use permit, often with accessibility, exit and fire-separation upgrades. Fine Engineering checks the zoning before anything is drawn.

  • No. A building permit covers construction and changes of use under the Building Code Act. A business licence is a separate municipal approval to operate, and which businesses need one depends on the municipality and the type of business. A new restaurant or clinic can need both, applied for separately. Fine Engineering works out which ones apply to an address before the lease is signed.

  • The number of people a space is designed to hold under the Ontario Building Code, worked out from its use and floor area. It sets the number of exits, exit widths and washrooms and, for a bar or restaurant, the capacity on the liquor licence. Fine Engineering calculates occupant load in every commercial permit set.

  • It depends on the building’s size, height and occupancy, and on whether the base building is already sprinklered. A change to a higher-hazard use, such as a restaurant or an assembly space, can trigger sprinklers where none existed. A restaurant is a different occupancy from an office, so the switch needs a change of use permit before any fit-out starts, and the kitchen exhaust, plumbing and fire separations go on the same application. Health approval and, where alcohol is served, an AGCO liquor licence follow separately. Fine Engineering draws the permit set and the licence plans together.

  • It is the building permit for work on a commercial building or unit: a tenant fit-out, an alteration, an addition or a new building. Ontario’s Building Code Act says no one may construct or demolish a building until the chief building official has issued a permit, and constructing includes materially altering an existing one. In Kitchener the reviewer is the City of Kitchener Building Division. Every Kitchener lot sets its own terms: the previous use of the unit, the base building’s fire separations and exits and the landlord’s own drawings decide how much the permit set has to cover.

Change of use across Doon Pioneer Park and Stanley Park

Kitchener runs to older homes around the core and Victoria Park with postwar and newer suburban subdivisions in Doon and Huron. A house on an established street that becomes an office or a clinic is a change of use, and the zoning for that street is read before anything else, since a permit can only be issued for a use the by-law allows there.

Fire separations in a Kitchener change of use

On Weber Street we turned a dental office into a supermarket: an interior renovation with a new plumbing system, and fire separations brought up to the Ontario Fire Code. That code covers buildings already standing, and the owner is responsible for meeting it. When a Kitchener unit changes use, we check the separations the last tenant relied on before the fit-out set goes to the City of Kitchener Building Division.

About a fifth of Kitchener’s properties are still zoned under By-law 85-1, and a commercial unit on one of them takes its permitted uses from that by-law, not from 2019-051.
