(416) 990-9179Possibly. Newmarket has a site alteration by-law of its own, and we confirm with the Town of Newmarket Building Division whether it reaches a house lot before the deck is drawn. On the newer infill lots on former golf-course land, we also check that levelling for a deck keeps the lot draining the way it was graded.
If the lot is inside the regulated area of the Lake Simcoe Region Conservation Authority (LSRCA), yes. Ontario Regulation 41/24 counts building or enlarging a structure as development activity, so a deck near a watercourse, a wetland or a valley in Newmarket can need an LSRCA permit before the Town of Newmarket Building Division issues the building permit. A deck in the subdivisions built from the 1970s on gets the same check as one behind a heritage home, because the LSRCA map decides, not the age of the street.

Three things to start: property address; photos of the yard and the wall the structure would attach to; and rough size, and whether you want it covered. Send those and we tell you what the Town of Newmarket Building Division will ask for before we quote.
They can. Digging a footing hole among the roots can injure a tree, and Newmarket’s Private Tree Protection By-law 2022-10 needs a Private Tree Permit before a private tree measuring 20 cm or more through the trunk at 1.4 m is injured, as well as before removal. Trees under the Town’s Woodlot By-law or York Region’s Forest Conservation By-law are exceptions to that permit, so we sort out which rule covers each tree, then space the footings around the roots before the Town of Newmarket Building Division sees the drawings.
Comprehensive Zoning By-law 2010-40, unless the property is in one of the Urban Centres, which have their own Urban Centres Zoning By-law 2019-06. We check the setbacks in whichever applies against your survey before settling the deck’s size. Meeting the Building Code does not settle zoning, and the Town of Newmarket Building Division reviews both before a permit is issued.
It may be. Lower Main Street South is the one Heritage Conservation District Newmarket has under Part V of the Ontario Heritage Act, and a front porch is part of what the street sees. For an address inside the boundary we ask the Town what the district looks for in the posts, railings and roof before detailing the footings and framing for the Town of Newmarket Building Division.
No. Newmarket is a lower-tier municipality, and York Region looks after regional roads and servicing rather than house permits, so the Town of Newmarket Building Division receives the deck drawings and sends its inspector. We arrange the inspections in order as each stage of the deck is finished.
Usually. A basement unit under By-law 2026-10 needs a building permit from the Town of Newmarket Building Division, and if the exit from that unit crosses a landing, a small deck or exterior steps, we include that structure in the unit’s drawings. The Building Code then sets its guards for a house that has a secondary suite.
Yes. Newmarket takes building permit applications on its Development Portal and lets applicants follow them there, so once we file the deck you can see where it stands with the Town of Newmarket Building Division. Our drawings show each footing’s size and depth, the beam and joist spans, the guards and the stairs, and the inspector checks what was built against them.

Not covered here? Book a free consultationUsually, yes. Each municipality sets its own line. The GTA rules we work with go by the deck’s height above the ground, and some also count any deck fastened to the house. A roofed porch fastened to the house needs one under each of them. Cities word the rule differently, so Fine Engineering checks your municipality’s own wording before a deck is drawn.
Start with drawings and, in most cases, a permit, then build from the ground up. Once the permit is issued, call for utility locates, dig the footings to the depth your soil needs and call in each inspection the permit lists as that stage is reached. Then come the framing, the decking, the guards and stairs, and the final inspection. Fine Engineering draws and builds decks across the GTA.
As part of the deck, on the same permit drawings. The stringers are cut to the drawing and fastened to the deck framing, and the guard rule that applies to the deck applies to the open sides of the stair too. Fine Engineering draws the stair, its stringers and its guard on the permit set.
Either the main roof carries down over the porch, or a lower shed roof hangs off the house wall. Both put new roof and snow load on the house, so the join needs flashing and the existing wall and roof framing has to carry it. Fine Engineering checks that framing before the porch roof is drawn.
For a permit, the zoning by-law decides. Zoning is applicable law, so a permit is only issued for work that complies with it. If a covered porch would take the lot past what its by-law allows, the owner makes the porch smaller or gets a minor variance first. Fine Engineering reads the by-law for your lot, including how it treats a roofed porch, before the porch is drawn.
Most often because water crosses a property line, the ground slopes too gently away from the house, or the swales and elevations do not tie into the survey. Reviewers also return plans that lack erosion control, or an engineer’s stamp where one is required. Fine Engineering designs grading to each municipality’s own criteria and revises the plan to answer the reviewer’s comments.
Good to know
In Newmarket the reviewer is the Town of Newmarket Building Division. Every Newmarket lot sets its own terms: the height above grade, the wall the deck fastens to and the soil under the footings decide the design before anything is dug.
We walk the site with the survey, usually within a day or two of the call, before anything is drawn, then file the decks & porches package to the Town of Newmarket Building Division’s own checklist.
Housing in Newmarket runs to heritage homes around Main Street with 1970s to 2000s subdivisions beyond, plus infill on former golf-course lands. An infill house can have its deck drawn with it, so the house and the deck are on one set of drawings. A front porch on a heritage house around Main Street faces the street, so its posts and railing are drawn to suit the house.
A rear canopy or covered porch on one of Newmarket’s older houses puts new roof load, snow included, onto an exterior wall framed long before today’s Building Code. Our engineer looks inside that wall, at the studs, the header over any door and what sits under it, before deciding whether a ledger can be fastened there.
Where it can, the ledger and its fasteners are detailed on the drawings. Where it cannot, the canopy is carried on posts and footings of its own, and the joint with the house only has to keep the weather out.
Some Newmarket properties sit in the Oak Ridges Moraine area, and for those the Town asks owners to go to its Planning Department for zoning information. On such a lot we get that answer before the deck is laid out, because it sets the setbacks and how much of the yard the deck may cover.
