  3. Grading & drainage design

    Proposed elevations, slopes and swales are set so runoff stays on your lot and reaches the street or a storm connection, with calculations where the city asks for them.

  4. Submission & approvals

    We file the grading plan with the building permit or the site alteration application, respond to the reviewer’s comments at no extra charge, and coordinate with the conservation authority where one is involved.

  • It depends on the work. Markham’s Site Alteration By-law 2011-232 covers larger sites; detached infill and additions go through the city’s Residential Infill Grading and Servicing (RIGS) review instead. We read that by-law against your plans at the start and file the grading plan, with its erosion and sediment control, under whichever application Markham requires.

  • If the lot is in a TRCA Regulated Area, yes. TRCA’s rule is that filling, changing grade or building anything there needs its permit, and you must have it before Markham issues a building permit. We check the regulated-area mapping when the survey comes in, so the same elevations go to both reviewers.

  • Often, yes. Markham’s Tree Preservation By-law 2023-164 regulates the injury or destruction of private and City trees, and property owners must apply for a permit before injuring or destroying any private tree with a trunk diameter of 20 centimetres or more, measured 1.37 metres above ground level at the base of the tree, regardless of the tree’s health or risk level. The city trees it protects matter most when a driveway is widened toward the street. Since the by-law covers injuring a tree as well as removing it, we plot the protected trees from the survey before setting grades, and either keep cuts and fills clear of them or raise the permit with you early.

  • Yes. We take on site engineering across Markham, including Unionville and Thornhill, about half an hour from our Richmond Hill office. The first consultation is free, by phone or on site.

  • Three things to start: property address and a recent topographic survey, if you have one; what you are building, paving or regrading; and architectural or pool drawings, if another designer prepared them. Send those and we tell you what the City of Markham Building Standards Department will ask for before we quote.

  • When the house or addition you want breaks one of By-law 2024-19’s limits, a side yard or a height for example, and the shortfall is small enough to argue as minor. The Committee hears the minor variance, and until that approval is in hand the Building Standards Department cannot issue the permit. We prepare the drawings for the application and set the grading to the version the Committee approves.

  • It may. Markham protects four heritage conservation districts under Part V of the Ontario Heritage Act: Thornhill, Markham Village, Buttonville and Unionville. Before we draw new paving, steps or walls in one, we ask the city whether the district’s requirements reach that work, and any permit that comes with it still goes to the Building Standards Department as usual.

  • Not on every lot. By-law 2024-19 allows a unit in an accessory building only where the lot holds a detached house, a semi-detached house or a townhouse, and none at all in a GWY1 zone or on TRCA hazard lands. We check the zone on the city’s map and the hazard limits on TRCA’s mapping before placing the unit on the grading plan.

  • Because both go through the city’s Residential Infill Grading and Servicing review, which looks at how the lot will drain and how the house will connect to the water and sewer services. The plan shows the existing and proposed elevations, the swales and downspout outlets that take runoff to the street or a storm connection, and the service lines. For an infill house in Thornhill or Unionville, we start from a topographic survey of the lot and the neighbours’ grades along each lot line.

  • On urban residential land outside the Greenbelt, Ontario now reads a zoning by-law’s minimum setback as 90 per cent of the stated distance. Where that applies to a Markham lot, the setbacks in By-law 2024-19 are measured that way, which can bring an addition within the rules without a minor variance. We confirm the lot qualifies before relying on it, since the Greenbelt and some prescribed areas are left out, and the Building Standards Department reviews the permit on the same basis.

  • There is no flat price, because the work changes with the lot. The size and slope of the property, how much of it the project regrades, whether the city wants runoff calculations or a stormwater note, and whether a conservation authority is involved all change the scope.   • Compare the two sets of elevations first. Existing grades come from the topographic survey, and proposed grades are the finished levels the plan sets. Arrows show which way surface water runs, swales carry it along the lot, and the fall between spot elevations shows whether it drains away from the house. Fine Engineering will go through a plan with you on a free first call.

  • Often, yes. Ontario lets each municipality require a permit for filling, removing topsoil or changing the grade, and many GTA municipalities use that power for backyard work that moves soil or changes the drainage. Some instead review the grading with a building permit, or exempt minor landscaping. Fine Engineering checks the local by-law and prepares the application.

  • Widening a driveway usually needs permission from the municipality, because zoning by-laws limit driveway width and the share of the front yard that can be hard surface, and the curb cut belongs to the city. Repaving the same footprint often does not. Fine Engineering reviews the by-law and prepares the site plan where one is needed.

  • A basement with a full-height door to the rear yard, made possible by grading the yard down to the basement floor level. It changes the lot’s drainage, so municipalities generally require a grading plan with it, and some also require a site alteration permit. Fine Engineering designs walkout grading with the structure and the permit set.

  • Zoning decides what can go on a lot: the use, height, setbacks and coverage, under the municipal zoning by-law. A building permit decides how it is built, under the Ontario Building Code. The permit review checks zoning too, and a design that misses a zoning rule needs a minor variance before the permit can be issued. Fine Engineering reviews both before drawing.

Grading plans and site alteration in Markham

In Markham the reviewer is the City of Markham Building Standards Department. Every Markham lot sets its own terms: the fall of the lot, where the neighbours’ water already goes and whether a storm connection or a rear catch basin is within reach set the grading design before any elevation is written.

We walk the site with the survey, usually within a day or two of the call, before anything is drawn, then file the site engineering package to the City of Markham Building Standards Department’s own checklist.

Lot grading in Unionville and Thornhill

With Markham’s stock running to heritage village cores in Unionville and Markham Village surrounded by 1980s to 2000s subdivisions and newer planned communities like Cornell, the subdivision lots were graded to an overall plan when they were built, so a pool, a walkout or a wider driveway there has to meet those grades at the lot lines.

O. Reg. 41/24 sets the lines TRCA works to on a Markham lot: an apparent valley with stable slopes extends to the stable top of the bank plus 15 metres, and development within 30 metres of a wetland needs its permit.

TRCA permits for grading plans in Markham

TRCA requires a pre-submission consultation before an application, issues permits only in the owner’s name and does not allow them to be transferred. A permit is typically valid for two years, so the Markham building permit and the site work are planned to fall inside that window.

TRCA itself is changing. A 2026 Ontario statute merges it with the Central Lake Ontario Conservation Authority on a transition date of February 1, 2027 or later, as the Central Lake Ontario Regional Conservation Authority. For a Markham lot, we confirm at the consultation which body will issue the permit.

Minor variances from Markham’s By-law 2024-19

A Committee of Adjustment may grant a minor variance only if it finds the change minor, desirable for the appropriate use of the property, and in keeping with the general intent of both the zoning by-law and the official plan. For a Markham lot, the by-law in question is 2024-19 wherever it applies, so our drawings show the standard being varied, by how much, and how the design keeps to the by-law’s intent.

Draining the yard around a Markham backyard unit

Under By-law 2024-19, putting a unit in an accessory building limits the house to one unit inside. The new footprint also covers ground that used to soak up rain, so our grading plan raises the unit’s floor above the ground around it, slopes the yard away on every side and takes the roof water to a point on the lot where it can drain without crossing a property line.
